I. What kind of information do we collect from you when you visit our site?
When you visit libertycellars.com, our stats package from WineDirect collects some basic information about your browser. Examples are things like what type of browser and operating system are you using; how long did you stay on our site; what pages did you look at. This helps us understand how visitors browse our site, so that we can continue to improve everyone's shopping experience.  We also collect personal information about you when you check out of our store such as your name, address, zip code, phone number, etc. We need this information to process payment and ship merchandise to you.

II. Sharing of personal information – we don't do it.
We do not share any personal information that we collect with any third parties or web sites [besides credit card processor?]. All the information you give us is held private and used solely for order processing and shipping. If you give us permission to send you marketing emails, then we use your email for that purpose; never do we sell or distribute that email to any other web site or list.

III. Email List Options.
If you have chosen to opt into our newsletter or marketing emails and decide to opt out, we have a simple unsubscribe form that will let remove you from those lists [set up]. Also, there is a checkbox in your member login to unsubscribe [true?].

IV. Consumer inquiries.
If you have any questions about your privacy, or want to make changes to your profile, or get off our marketing list, simply send us an email.

V. Protecting your information.
All the payment information we collect is done so under SSL – a standard internet security measure. Any data that we store about you is kept behind a secure firewall in our database and is not accessible to the public in any way.

Legal Requirements
You must be 21 years of age or older to order or receive alcoholic beverages from us. Receipt of shipments containing alcoholic beverages requires the signature of a sober adult (a person 21 years of age or older who is not intoxicated). Wines purchased from us are not for resale and are for personal consumption only.

Credit Card Charges
Orders are by credit card only. We accept Visa, MasterCard, and American Express.

Minimum Purchase
No minimum purchase is required unless specified otherwise.

States Authorized for Direct Shipment
Due to the ever-changing nature of wine shipping laws, we are currently shipping only to the following states:  California, Minnesota, District of Columbia.  We may be able to ship wines, directly or indirectly, to all states except as prohibited by - please contact us if your desired state for receipt is not listed above. If we are unable to ship directly to your state, we might be able to arrange for the sale and shipment of our products through a third party. Please note, when dealing through a third party, wine prices, discounts, and shipping costs may differ from those quoted by us.

Shipping
UPS Ground, GLS, and FedEx Ground are carriers offered through our website (common carrier). Ground shipping is provided by them at current market rates. *Note – If the customer selects shipping by Air as their carrier, the customer pays all shipping charges, regardless of his or her wine club membership or purchase amount.

Carriers and methods vary from state to state, to optimize quality control and expediency. Once the carrier picks up your package(s) from our fulfillment house, tracking information and an estimated delivery date will be emailed directly to you. Please be sure that an adult 21 years of age or older is available to sign for the shipment when it arrives on the scheduled delivery day. In the event of extreme weather conditions, we may delay shipping. All shipping issues must be acknowledged within 30 days of the original ship date for attempted resolution. 

ALL ORDERS MUST BE SIGNED FOR BY A PERSON 21 YEARS OF AGE OR OLDER UPON RECEIPT, SO PLEASE CHOOSE YOUR SHIPPING ADDRESS ACCORDINGLY. WE RECOMMENDS SHIPPING TO A BUSINESS ADDRESS, A CARRIER HUB LOCATION, OR AN ADDRESS WHERE AN ADULT IS READILY AVAILABLE, TO ENSURE A SUCCESSFUL FIRST DELIVERY ATTEMPT. SHIPPING FEES INCURRED TO RESHIP ORDERS RETURNED TO US DUE TO FAILED SIGNATURE AND DELIVERY ATTEMPTS ARE THE CUSTOMER’S RESPONSIBILITY.

Wine is a Delicate Commodity
Wine is a perishable commodity and can be damaged or affected by conditions such as extremes of temperature (e.g. heat and humidity in summer and cold winter weather may adversely affect the condition of your wine during shipment). We are not responsible for, and will not replace wine that is damaged by extreme weather conditions during shipment. When your wine order is picked up by the common carrier for delivery, responsibility for the wine becomes the responsibility of the purchaser.

Customers and Club members are responsible for maintaining current address and credit card information by either updating in the member/customer protal or notifying us of any changes to shipping information at least two weeks prior to the published ship date.  Packages needing to be redirected at the time of shipping will incur a $20 per package fee. Returned or undeliverable shipments will result in additional shipping charges.  All shipments must be received within three delivery attempts.  Wine cannot be shipped to PO Boxes.  A restocking fee of 15% will apply to cancelled orders.

We want to ensure that your experience is as exceptional as the wine. If there has been any damage during shipping, please contact us within thirty days of receipt of the wine. After thirty business days after delivery, we are not responsible for damaged bottles. 

Refund Policy
Our refund policy is on a case-by-case basis. All sales are final, product can be returned only if the wine is corked and the bottle is returned for our analysis. We can replace the bottle or refund the customer at our discretion.

Wine Club Terms

By joining a Liberty Wine Club of any level, each Member agrees to the following terms and conditions:
– You certify that you are at least 21 years of age (or the recipient of your gift membership is at least 21 years of age).
– You understand that all memberships are for a minimum of two shipments. You may cancel the membership after two shipments if notice is received by Liberty in writing at least 10 days prior to next scheduled billing date.   You agree to receive Club shipments in accordance with Club shipment schedule as set forth by Liberty.
– You hereby authorize Liberty to charge your credit card up to 5 business days prior to each shipment.
– You understand and accept that pricing is subject to change during the term of your membership.
– You are aware that the government and shipping couriers require wine shipments to be signed for at time of delivery by an adult over the age of 21 and that age identification may be required. Shipping to a business address is recommended (with the adult signature still required). 
– You agree that all alcoholic beverages are sold in California and title passes to the you. We make no representation to the legal rights of anyone to ship or import any wines into any state outside of California. By placing an order, you authorize Liberty to act on your behalf to engage a common carrier to deliver your order. You understand that you are responsible for all costs incurred if your wine shipment is undeliverable due to outdated or inaccurate contact information. You agree to maintain current shipping and payment information in the Liberty member portal through the duration of your membership.  You understand that shipping costs in any order pertain to the initial effort to ship and deliver the package and that any returned items which must be reshipped will be charged separately on your credit card.
